Terms of Use
Last Updated: October 9, 2026
These Terms of Use ("Terms") govern your use of the Gym Journal mobile application ("the app") and of this website, gymjournal-app.com, including its guides, exercise library and calculators ("the site"). By creating an account or using the app or the site you agree to these Terms. If you do not agree, do not use them. Where these Terms say "the app", they cover the site too, unless a section is plainly about the app alone, such as subscriptions or account deletion.
Section 15 contains a binding arbitration agreement, a class-action waiver and a jury-trial waiver. If you live in the US, it affects how disputes between us are resolved and limits your right to go to court or have a jury trial. You can opt out within 30 days — see section 15 for how. It does not apply to users in the EU, UK or EEA.
Gym Journal is a tool for tracking workouts and is not a substitute for professional medical, fitness, or nutritional advice. Strength training carries inherent risks of injury. Consult a qualified physician before beginning any exercise program, especially if you have a pre-existing condition. You exercise at your own risk. We are not responsible for any injury, illness, or damage that results from following routines generated, logged, or suggested inside the app or on this site, except where the law makes us responsible — see section 9.
1. Your account
You must be at least 13 years old (or the minimum age of digital consent in your country, whichever is higher) to use Gym Journal. You are responsible for the accuracy of the information in your profile and for safeguarding your password. You may only create one account per person. Sharing an account is not permitted. You may delete your account at any time from Settings → Account & Data → Delete Account. Deletion is permanent. The AI features have a higher minimum age of 18 (see section 6).
2. Acceptable use & content moderation
You agree not to: Post content that is illegal, hateful, harassing, sexually explicit, threatening, or that infringes someone else's rights. Impersonate another person or misrepresent your identity. Upload spam, malware, advertising, or links to off-platform commercial offers. Reverse-engineer, decompile, or attempt to bypass the app's technical limitations. Use the app to harvest other users' data, scrape the community feed, or build a derivative product. Submit deliberately false workout data to manipulate leaderboards, badges, or community standing. Content moderation & timely turnaround: We operate a zero-tolerance policy toward objectionable content and abusive behavior. You can report abusive content in-app (long-press a post → Report) and block users (profile → Block). We review all user reports and strive to take appropriate action on objectionable content or abusive accounts expeditiously, typically within 24 hours of receiving a report, including content removal, warnings, or account suspension and termination. Other users. Posts, comments, routines and advice from other users are their own, not ours, and we do not check them before they appear. Your dealings with other users are between you and them, although we will act on reports as described above. EU Digital Services Act (DSA) Notice-and-Action: Under Regulation (EU) 2022/2065 (DSA), any individual or entity may submit a notice regarding illegal content by emailing our designated single point of contact at contact@gymjournal-app.com (supported languages: English and Romanian). Notices must include: (a) an explanation of why the content is considered illegal; (b) the exact location/URL or description of the content; (c) the notifier's name and email; and (d) a statement of good faith. When we remove content or restrict an account, we provide the affected user with a statement of reasons (Art. 17 DSA). Affected users may appeal any moderation decision free of charge within 6 months of notification through our internal complaint-handling path by contacting contact@gymjournal-app.com (Art. 20 DSA).
3. Subscriptions & in-app purchases
Gym Journal offers optional Gym Journal Pro subscriptions and one-time purchases billed through Apple App Store or Google Play in-app purchases: Monthly and Annual are auto-renewing subscriptions. If there is no trial, or after any free trial ends, payment is charged to your Apple ID or Google Play account at the displayed price and renews for the same period unless canceled before renewal. Lifetime is a one-time purchase and does not renew. You can manage or cancel subscriptions any time from the app's Settings → Manage or Cancel Subscription link, from Settings → Apple ID → Subscriptions on your iPhone, or from Google Play → Profile → Payments & subscriptions on Android. Cancellation takes effect at the end of the current paid period. Any unused portion of a free trial is forfeited if you start a paid subscription. Refunds & EU Statutory Withdrawal Right: Refunds are handled directly by Apple or Google under their respective app-store refund policies. If you are an EU/EEA consumer purchasing digital content or subscriptions, you have a statutory 14-day right of withdrawal under EU consumer protection law, which is administered directly by Apple or Google as the merchant of record (e.g., via reportaproblem.apple.com or Google Play support). If you begin using a subscription immediately upon purchase, you acknowledge that your withdrawal right may be limited or waived once immediate performance has begun in accordance with store terms. Prices shown in the app are in your local currency where supported and are inclusive of applicable taxes.
4. Your content
You retain ownership of the photos, videos, posts, comments, and workout data you upload. By posting content publicly inside the community you grant us a non-exclusive, royalty-free, worldwide licence to host, display, and distribute that content within the app and its features (e.g., leaderboards, feeds). This licence ends when you delete the content or your account, except for backups that roll off within 30 days. Feedback. If you send us ideas, feature requests or other feedback, you give us a free, worldwide, perpetual licence to use, adapt and build on it, without owing you payment or credit. Please do not send anything you want to keep confidential.
5. Our content
The app and the site, their design, the exercise catalog, the guides and calculators on the site, badges, and any AI-generated routines we serve back to you are protected by copyright and other laws. You may use them only for your own personal, non-commercial training.
6. AI features & adult eligibility (18+)
Adults only (18+). AI Coach and AI Body Projection are available only to users who are 18 or older. By using either feature you confirm that you are at least 18. AI Coach. The AI Coach generates routine suggestions using an automated model. Output may be inaccurate, inappropriate for your goals, or unsafe for your body type or experience level. Treat AI Coach suggestions as starting points, not professional programming. AI Body Projection (“Future You”) & Adult Eligibility (18+). The AI Body Projection feature is intended solely for adult fitness and physique tracking purposes (users 18 years of age or older). The feature generates speculative, illustrative visualizations of possible muscular progression and body composition adaptations based on hypothetical consistent training. These visualizations are illustrative estimates only and do NOT constitute medical diagnoses, clinical advice, health promises, or guaranteed physical outcomes. Actual physique adaptations depend on individual genetics, caloric intake, recovery, compliance, and biological factors. Photos submitted for body projection are processed transiently via secure cloud inference (Google Gemini API) and are never stored on our servers or used for model training. The generated image is saved exclusively on your local device. The health-and-safety notice at the top of these Terms applies in full to anything the AI Coach or AI Body Projection produces.
7. Availability & changes
We aim to keep the app available, but we don't guarantee uninterrupted service. We may update, change, or discontinue features at any time. We may also update these Terms. For a material change we will tell you in-app or by email at least 30 days before it takes effect, unless the change is required by law or needed urgently for security or to stop abuse, and the "Last updated" date above will change. If you do not agree, you can cancel your subscription and delete your account before the change applies. Using Gym Journal after the change takes effect means you accept the updated Terms. What changed on 9 October 2026. These Terms now cover the website as well as the app, so the health-and-safety notice also applies to the guides and calculators on the site. AI Coach is now adults-only (18+), like AI Body Projection (section 6). We added an "Other users" paragraph (section 2), a feedback licence (section 4), a clear statement of the liability we never exclude, including for personal injury caused by our negligence (section 9), a reminder that your statutory consumer rights are unaffected (section 8), an assignment clause (section 13) and an explicit jury-trial waiver for US residents (section 15). Material changes to these Terms now come with at least 30 days' notice. What changed on 18 August 2026. We explicitly documented the adult eligibility requirement (18+) and fitness-estimate nature of the generative AI Body Projection ("Future You") feature under Section 6, reinforcing health-and-safety guidelines and non-medical disclaimers. Earlier on 16 August 2026, we added an explicit 24-hour response-time commitment for user-reported objectionable content under Section 2, established the formal EU Digital Services Act (DSA) notice-and-action and appeal mechanism under Articles 16, 17, and 20, and documented the EU statutory 14-day right of withdrawal administered by app stores under Section 3.
8. Disclaimer of warranties
The app is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the app will be uninterrupted, error-free, or that the AI Coach output, AI Body Projection visualizations, badges, statistics, or any other feature will be accurate. Your statutory rights. If you are a consumer in the EU, the UK or another country that gives you rights over digital content and services you use — such as the right to have them work as described — nothing in these Terms limits those rights.
9. Limitation of liability
To the maximum extent permitted by law, in no event will Gym Journal, its developers, or its providers be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising out of or related to your use of the app — including, without limitation, any physical injury or health condition resulting from following content you saw or generated inside the app. Our total liability for any direct damages is limited to the amount you paid for the app in the twelve months preceding the claim, or US $50, whichever is greater. Some jurisdictions do not allow these limitations; in those places these limits apply only to the extent permitted. What we never exclude. Nothing in these Terms — including this section and the health-and-safety notice — excludes or limits our liability for death or personal injury caused by our negligence, for harm we cause intentionally or through gross negligence, for fraud, or for any other liability that cannot be excluded or limited under the law that applies to you.
10. Termination
We may suspend or terminate your account if you breach these Terms or use the app in a way that we reasonably believe is unlawful, harmful to other users, or harmful to the service. You may stop using the app at any time and delete your account in-app.
11. Governing law
These Terms are governed by the laws of Romania and the applicable laws of the European Union, without regard to conflict-of-laws rules. Disputes will be brought exclusively in the competent courts of Romania, except where mandatory consumer-protection law in your country of residence grants you the right to bring proceedings locally.
12. Apple App Store (applies to the iOS app)
These Terms are concluded between you and STANICHEVICI TUDOR PFA only, and not with Apple Inc. ("Apple"). Apple is not responsible for the app or its content. You acknowledge that: Scope of licence. The licence granted to you for the app is a non-transferable licence to use the app on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. Maintenance and support. We, not Apple, are solely responsible for providing any maintenance and support for the app. Apple has no obligation to furnish any maintenance or support services. Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you (if any); to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the app. Claims. We, not Apple, are responsible for addressing any claims by you or any third party relating to the app or your use of it, including product-liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer-protection, privacy, or similar legislation. Intellectual property. In the event of a third-party claim that the app or your use of it infringes that party's intellectual-property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim. Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist-supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
13. Severability, assignment & entire agreement
If any provision of these Terms is held invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will remain in full force. If we do not enforce a provision straight away, we can still enforce it later. These Terms, together with our Privacy Policy, form the entire agreement between you and us regarding the app and supersede any prior agreements on the same subject. Assignment. We may transfer our rights and obligations under these Terms to another business — for example, a company set up to run Gym Journal, or a buyer of it — as long as this does not reduce your rights under them. We will tell you if that happens. You may not transfer your rights under these Terms without our written consent.
14. Copyright complaints & DMCA
Gym Journal hosts content that users upload — posts, photos, videos, comments, and shared routines. We respect intellectual-property rights and respond to valid infringement notices. Designated agent. Notices of claimed copyright infringement should be sent to our designated agent: Copyright Agent — STANICHEVICI TUDOR PFA Email: dmca@gymjournal-app.com Postal address: available on request via the email above. What a valid notice must include. Under 17 U.S.C. § 512(c)(3), your notice must contain: (a) a physical or electronic signature of the copyright owner or a person authorized to act on their behalf; (b) identification of the copyrighted work claimed to have been infringed; (c) identification of the material claimed to be infringing and information reasonably sufficient to let us locate it (a direct link to the post or comment is best); (d) your contact details, including address, telephone number and email; (e) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and (f) a statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf. What we do. On receipt of a valid notice we will remove or disable access to the material expeditiously and take reasonable steps to notify the user who posted it. Counter-notification. If you believe your content was removed by mistake or misidentification, you may send a counter-notice to the same address containing: your signature; identification of the removed material and where it appeared; a statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification; your name, address and telephone number; and a statement that you consent to the jurisdiction of the federal district court for your district (or, if outside the United States, any district in which we may be found) and that you will accept service of process from the complaining party. If we receive a valid counter-notice we may restore the material in 10 to 14 business days unless the original complainant notifies us that they have filed a court action. Misrepresentations. Under 17 U.S.C. § 512(f), knowingly misrepresenting that material is infringing — or that it was removed by mistake — can make you liable for damages, including costs and legal fees. Repeat infringers. We maintain a repeat-infringer policy: accounts that are the subject of repeated valid infringement notices will be terminated in appropriate circumstances.
15. Dispute resolution, arbitration & class-action waiver
PLEASE READ THIS SECTION CAREFULLY. IF YOU LIVE IN THE UNITED STATES IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL. First, talk to us. Most problems can be sorted out quickly. Before starting any formal proceeding, please email contact@gymjournal-app.com describing the dispute and the relief you want. We will try in good faith to resolve it within 30 days. This step is a condition of starting arbitration, and it applies to us as well as to you. WHO THIS SECTION APPLIES TO. The arbitration agreement, class-action waiver and jury-trial waiver below apply ONLY if you are a resident of the United States. If you live in the European Union, the United Kingdom, or the European Economic Area, this arbitration agreement does NOT apply to you; your rights are governed by section 11 (Governing law) and by the mandatory consumer-protection law of your country of residence, including your right to bring proceedings in the courts of your own country and to use any applicable out-of-court dispute-resolution scheme. Agreement to arbitrate (US residents). You and STANICHEVICI TUDOR PFA agree that any dispute, claim or controversy arising out of or relating to these Terms or your use of the app that is not resolved through the informal step above will be settled by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitrator, and not any federal, state or local court, has exclusive authority to resolve any dispute about the interpretation, applicability, enforceability or formation of this arbitration agreement — except that a court decides whether the class-action waiver below is enforceable. The Federal Arbitration Act governs this agreement to arbitrate. CLASS-ACTION WAIVER (US residents). YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding. If this class-action waiver is found unenforceable as to a particular claim or request for relief, then that claim or request must proceed in court and be severed from any arbitration. JURY-TRIAL WAIVER (US residents). BY AGREEING TO ARBITRATION, YOU AND WE EACH WAIVE THE RIGHT TO A TRIAL BY JURY FOR ANY CLAIM COVERED BY THIS ARBITRATION AGREEMENT. HOW TO OPT OUT. You may reject this arbitration agreement, the class-action waiver and the jury-trial waiver by emailing contact@gymjournal-app.com with the subject line "Arbitration Opt-Out" within 30 days of the date you first accept these Terms, stating your name and the email address on your account. Opting out affects nothing else in these Terms, and we will not close your account or treat you differently for doing so. If you opted out, disputes go to the courts identified in section 11. Exceptions. Either of us may bring an individual claim in small-claims court if it qualifies, and either of us may seek injunctive or equitable relief in court to stop infringement or misuse of intellectual property. Nothing here prevents you from reporting a matter to a government agency. Fees and location. AAA's Consumer Arbitration Rules govern the allocation of filing and arbitrator fees. Arbitration will take place in the US county where you live, or by telephone, video or written submissions at your election, unless we both agree otherwise. Coordinated filings. If 25 or more similar claims are asserted against us by the same or coordinated counsel, the claims will be filed and resolved in batches of no more than 50, with a single arbitrator per batch, and any applicable limitation period will be tolled for claims awaiting their batch. Survival and severability. This section survives termination of your account. If any part of it other than the class-action waiver is found unenforceable, the remainder stays in force. Mandatory consumer rights. Nothing in this section removes any right you have under the mandatory consumer-protection law of your country or state of residence where that law cannot be waived by agreement.
